1. Introduction

You have accessed the website of PureTech Home Services LLC, a Wisconsin limited liability company ("PureTech Home Services," "Company," "we," "us," or "our"). For purposes of these Terms of Use ("Terms"), the “Site” includes [www.PURETECHHS.com] and any webpages, mobile sites, or applications owned or controlled by PureTech Home Services that link to these Terms (collectively, the "Site").

By accessing or using the Site, booking or purchasing any services or products through the Site, or otherwise interacting with the Site (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, do not use the Site.

2.1 Communications Consent

​When you submit a booking request, estimate request, or other form on the Site, you acknowledge that the contact information you provide may be used by PureTech Home Services to call, e-mail, or text you solely in connection with that request. You further agree that such calls or texts may be placed using automated technology and that standard carrier charges may apply. You may withdraw your consent at any time by following the instructions in any message or by contacting us at support@puretechhs.com. Consent is not required to purchase goods or services.

3. Eligibility

The Site is intended for use by individuals 18 years of age or older. By using the Site, you represent that you are at least 18 and have the legal capacity to enter into these Terms.

4. Intellectual Property

All content on the Site—including text, graphics, logos, images, audio clips, video, and software—is the property of PureTech Home Services or its content suppliers and is protected by U.S. and international copyright, trademark, and other intellectual‑property laws. You are granted a limited, non‑exclusive, non‑transferable license to access and use the Site for your personal, non‑commercial use. No content may be reproduced, modified, or distributed without our prior written permission.

5. Permitted & Prohibited Uses

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  1. Use the Site in any way that violates federal, state, local, or international law or regulation.

  2. Upload or transmit any viruses, malware, or other harmful code.

  3. Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems.

  4. Use any robot, spider, or automatic device to monitor or copy Site content without our prior written consent.

  5. Impersonate PureTech Home Services, our employees, or any other person or entity.

6. Online Bookings, Estimates & Purchases

  1. Booking Requests. Submitting a scheduling request constitutes an offer to purchase the relevant Services. Acceptance occurs only when we send a written confirmation.

  2. Estimates. Any price estimate provided through the Site is non‑binding until confirmed in a written Service Agreement or Work Order signed by both parties.

  3. Payments. You agree to pay all fees and charges in accordance with the payment terms displayed at checkout or otherwise provided to you.

6.1 Cancellation & Rescheduling Policy

  • Notice Windows

    • Standard Services (radon measurement, filter replacement, on‑site consultation): You may cancel or reschedule up to 12  hours before the scheduled arrival time at no charge.

    • Projects Requiring Special‑Order Parts (mitigation installs, whole‑home systems): 72‑hour notice is required because materials are ordered specifically for your job.

  • How to Cancel / Reschedule

    • Send an email to [support@puretechhs.com] and call 608-292-4221 during business hours. Your change is effective when we confirm receipt in writing.

  • Late‑Change Fee

    • Changes made inside the applicable notice window incur a late‑change fee equal to the greater of (a) $50 or (b) 15 % of the quoted job price. This covers technician scheduling, reserved equipment, and administrative costs.

    • If we arrive on‑site and cannot perform the work due to inaccessibility, missing homeowner authorizations, or unsafe conditions, the same fee applies.

  • Deposit & Refunds

    • Any deposit you paid is fully refundable if you cancel within the notice window.

    • For late cancellations, the late‑change fee will be deducted from the deposit and the remainder (if any) returned within 7 business days.

  • PureTech‑Initiated Changes

    • We may reschedule for weather, supply‑chain issues, or safety reasons. We will notify you as soon as practical and offer the next available date or a full deposit refund—your choice.

  • Emergencies

    • We waive the late‑change fee for genuine emergencies (severe illness, fire, flood). We may request reasonable documentation.

7. Service‑Specific Disclaimers

​

7.1 Radon Measurement & Mitigation

  • Radon levels can fluctuate due to weather, seasonality, HVAC usage, and building conditions beyond our control.

  • We do not guarantee that radon concentrations will remain below federal or state guidelines after mitigation, although our goal is to reduce levels as low as reasonably achievable.

  • It is your responsibility to monitor for ongoing radon concentrations and to test or monitor your systems to ensure they remain effective.

7.2 Water Filtration, Reverse Osmosis & Air Quality Products

  • Filtration effectiveness depends on proper installation, regular maintenance, and timely filter replacement, which are your responsibility unless otherwise specified in a separate Service Agreement.

  • Third‑party product warranties, if any, are provided by the manufacturer; PureTech Home Services disclaims all responsibility for manufacturer warranty performance.

  • Customer Monitoring & Leak‑Damage Disclaimer

    • Ongoing Duty to Inspect.  After installation or service, you agree to visually inspect all filtration, softening, reverse‑osmosis, and related plumbing components for signs of moisture, drips, or pooling water.

    • Prompt Notice. If you observe or suspect any leak, reduced pressure, unusual sounds, or other malfunction, **you must shut off the system’s water supply (using the provided shut‑off valve or main shut off valve) and notify PureTech Home Services in writing.

    • Customer‑Caused or Unreported Leaks. PureTech is not liable for any property damage, mold remediation, higher utility bills, or other losses arising from leaks that (a) occur after our service date; and (b) were not reported to us within the time frame above.

    • Exclusion of Consequential Damages. To the fullest extent permitted by law, PureTech disclaims liability for indirect, incidental, special, or consequential damages, including but not limited to water damage to structure, furnishings, personal property, or loss of use, unless such damages are caused solely by PureTech’s gross negligence or willful misconduct.

    • Cap on Direct Damages. In no event will PureTech’s aggregate liability for direct damages related to any filtration‑system leak exceed (i) the amount you paid PureTech for the specific service giving rise to the claim, or (ii) US $5,000, whichever is less.

    • Homeowner’s Insurance. You acknowledge that you are responsible for maintaining adequate homeowner’s or renter’s insurance covering water‑related losses.

7.3 General Information Only

Any advice or information provided on the Site is for general informational purposes and should not be relied upon as professional, engineering, or medical advice.

8. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURETECH HOME SERVICES DISCLAIMS ALL WARRANTIES—EXPRESS OR IMPLIED—INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR‑FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

IN NO EVENT WILL PURETECH HOME SERVICES, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR SERVICES WILL NOT EXCEED THE GREATER OF (A) $[5,000] OR (B) THE TOTAL AMOUNT YOU PAID PURETECH HOME SERVICES FOR THE SERVICE(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations; those limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless PureTech Home Services and its owners, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

11. Third‑Party Links & Resources

The Site may contain links to third‑party websites or resources. These links are provided for convenience only; we do not endorse and are not responsible for the content, products, or services on or available from those websites.

12. Modification of Terms & Site

We reserve the right to modify these Terms or any portion of the Site at any time in our sole discretion. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes acceptance of those changes.

13. Governing Law & Dispute Resolution

These Terms and any dispute arising hereunder are governed by the laws of the State of Wisconsin, without regard to its conflict‑of‑laws provisions. Any dispute that cannot be resolved informally will be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules in Poynette, Wisconsin. YOU WAIVE ANY RIGHT TO A JURY TRIAL.

14. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision will not be deemed a waiver.

15. Entire Agreement

These Terms, together with any separate Service Agreement, Work Order, or policies expressly incorporated herein, constitute the entire agreement between you and PureTech Home Services regarding the Site and Services.
