Terms of Use

​​1. Introduction

You have accessed the website of PureTech Home Services LLC, a Wisconsin limited liability company ("PureTech Home Services," "PTHS," "Company," "we," "us," or "our"). For purposes of these Terms of Use ("Terms"), the "Site" includes www.puretechhs.com and any webpages, subdomains, landing pages, mobile sites, booking portals, or applications owned or controlled by PureTech Home Services or any PureTech Company that link to these Terms (collectively, the "Site").

By accessing or using the Site, booking or purchasing any services or products through the Site, or otherwise interacting with the Site (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, do not use the Site.

These Terms govern your use of the website. They do not replace the written Service Agreement you sign for any work we perform. If the two ever conflict, your signed Service Agreement controls. See Section 8.5.

2. The PureTech Companies — Who Provides Your Services
2.1 Our Company Family

"PureTech Companies" means PureTech Home Services LLC together with each subsidiary or affiliated company that PTHS controls from time to time. As of the Last Updated date above, the PureTech Companies are:

  • PureTech Home Services LLC — a Wisconsin limited liability company. Radon measurement and mitigation, indoor air quality services, and related home services. PTHS also owns and operates the PureTech brand, this Site, our advertising, our telephone number, and our scheduling, intake, and billing systems.

  • PureTech Electric LLC — a Wisconsin limited liability company, ninety percent (90%) owned by PureTech Home Services LLC. Wisconsin Electrical Contractor Registration No. 1701-EC. All electrical contracting, installation, service, and repair work offered under the PureTech brand.

 

We may form or acquire additional PureTech Companies. When we do, we will add them to this Section and to the table in Section 2.2 and revise the Last Updated date. Your continued use of the Site after that revision is posted constitutes acceptance under Section 16.

2.2 Which Company Contracts With You

Different PureTech Companies hold different professional credentials and perform different work. The company that contracts with you, performs the work, pulls the permit, and warrants the work depends on the type of service you purchase:

Radon services:

  • PureTech Home Services LLC

  • NRPP Radon Mitigation Specialist No. 115369

  • Radon mitigation system design, installation, service, repair, and fan replacement

  • PureTech Home Services LLC

  • NRPP Radon Measurement Professional No. 115257

  • Indoor air quality assessment, monitoring, filtration, testing

Electrical services:

  • PureTech Electric LLC

  • Wisconsin Electrical Contractor Reg. No. 1701-EC; work performed under the responsible supervision of Logan Schroeder, Wisconsin Master Electrician License No. 1372-ME

  • All electrical work — including dedicated circuits, panel and service upgrades, wiring, devices, fixtures, EV-charger circuits, generators, subpanels, troubleshooting, and code corrections

 

This Site, advertising, lead intake, scheduling, and billing administration

  • PureTech Home Services LLC

 

THE IDENTITY OF THE COMPANY THAT WILL CONTRACT WITH YOU AND PERFORM THE WORK IS STATED ON YOUR WRITTEN QUOTE AND SERVICE AGREEMENT BEFORE YOU AUTHORIZE ANY WORK OR MAKE ANY PAYMENT. THAT WRITTEN DISCLOSURE CONTROLS OVER ANYTHING ON THIS SITE.

2.3 Marketing and Advertising Are Conducted by PTHS

This Site, the PureTech Home Services Google Business Profile, our search and local services advertising, our review profiles, our social media accounts, our telephone number, and our estimate and scheduling systems are owned and operated by PureTech Home Services LLC on behalf of the PureTech Companies.

Marketing that appears under the "PureTech Home Services" name may describe or promote services that are contracted for and performed by an affiliated PureTech Company. Advertising, marketing, or informational content published by PureTech Home Services LLC is not an offer by PureTech Home Services LLC to perform electrical work. PureTech Home Services LLC does not hold a Wisconsin Electrical Contractor credential and does not offer, bid, contract for, or perform electrical construction in its own name.

All electrical construction offered or performed under the PureTech brand is offered, contracted for, and performed by PureTech Electric LLC, Wisconsin Electrical Contractor Registration No. 1701-EC, under the responsible supervision of Logan Schroeder, Wisconsin Master Electrician License No. 1372-ME.

2.4 Combined Projects — Radon Work That Includes Electrical Work

Most radon mitigation systems require a dedicated electrical circuit, a disconnect, or other electrical work. Where your project includes both radon scope and electrical scope, one of two structures applies. Your Quote will state which one.

  1. Single-contract structure. PureTech Home Services LLC is your sole contracting party for the entire project and engages PureTech Electric LLC — or another licensed electrical contractor — as its subcontractor for the electrical portion. PTHS remains responsible to you for subcontracted work within its scope, as provided in your Radon Mitigation Agreement. The electrical portion is nevertheless performed by, and permitted under the credential of, the licensed electrical contractor identified on your Quote, whose Wisconsin Electrical Contractor Registration Number will appear on the Quote and on any permit.

  2. Two-contract structure. You contract separately with PureTech Home Services LLC for the radon scope and with PureTech Electric LLC for the electrical scope, under two separate written agreements with separately stated pricing. Each company is responsible only for the scope of its own agreement, and each provides its own warranty on its own scope.

In either structure, the electrical work is performed by a licensed Wisconsin electrical contractor, permitted where required, and inspected where required. Warranty coverage for the electrical portion is provided by the company that performed it, on the terms of that company’s written warranty.

2.5 Credentials and Licensing

Current credentials held by the PureTech Companies and their personnel:

  • Wisconsin Electrical Contractor Registration No. 1701-EC — PureTech Electric LLC (expires 06/30/2030)

  • Wisconsin Master Electrician License No. 1372-ME — Logan Schroeder

  • NRPP Radon Mitigation Specialist No. 115369 — Zachary Copiskey

  • NRPP Radon Measurement Professional No. 115257 — Zachary Copiskey

You may verify any Wisconsin credential using the "Lookup a License" tool at dsps.wi.gov. Certificates of insurance for either company are available on request at any time and will be furnished before final payment is due.

2.6 Separate Companies; No Cross-Liability

Each PureTech Company is a separate legal entity with its own books, accounts, insurance, and contracts. Obligations under a Service Agreement are obligations of the contracting company only — not of any affiliated PureTech Company, and not of any member, manager, officer, employee, or contractor individually. Common ownership, a shared brand, a shared office address, or a shared telephone number does not make one PureTech Company liable for the obligations of another. Nothing in this Section limits any right or remedy you have under Wisconsin consumer protection law.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, share, and protect your information across the PureTech Companies.

3.1 Communications Consent

When you submit a booking request, estimate request, or other form on the Site, you acknowledge that the contact information you provide may be used by PureTech Home Services and the PureTech Companies to call, e-mail, or text you in connection with that request. You further agree that such calls or texts may be placed using automated technology and that standard carrier charges may apply. Consent is not required to purchase goods or services. You may withdraw your consent at any time by following the instructions in any message or by contacting us at support@puretechhs.com.

3.2 Text Messaging (SMS/MMS) Program Terms
  • Program. PureTech service and appointment messaging — scheduling, confirmations, technician arrival notices, estimates, invoices, service reminders, and, if you separately opt in, promotional offers.

  • Message frequency. Varies by the status of your request or project. Message and data rates may apply.

  • Opt out. Reply STOP to any message to stop receiving texts. You will receive one confirmation message and no further texts.

  • Help. Reply HELP to any message, or contact support@puretechhs.com or (608) 292-4221.

  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.

  • No sharing for third-party marketing. We do not sell or share your mobile number or your SMS opt-in with third parties for their own marketing.

3.3 Electronic Records and Signatures

You consent to conduct business with the PureTech Companies electronically and to receive quotes, agreements, change orders, notices, warranties, invoices, and required consumer disclosures by electronic means, including by e-mail and through our electronic signature platform. Electronic signatures and electronically transmitted documents have the same legal effect as handwritten signatures and paper documents. You may withdraw this consent and request paper copies at no charge by contacting support@puretechhs.com; withdrawal applies going forward only. To receive electronic documents you need an internet connection, a current browser, and a working e-mail address.

4. Eligibility

The Site is intended for use by individuals 18 years of age or older. By using the Site, you represent that you are at least 18 and have the legal capacity to enter into these Terms. Where you request work at a property, you further represent that you are the owner of the property or are authorized by the owner to request and authorize the work.

 
5. Intellectual Property
5.1 Our Content

All content on the Site — including text, graphics, logos, images, photographs, audio clips, video, diagrams, forms, and software — is the property of PureTech Home Services LLC, another PureTech Company, or our content suppliers, and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. No content may be reproduced, modified, scraped, republished, or distributed without our prior written permission.

5.2 Trademarks

"PureTech," "PureTech Home Services," "PureTech Electric," the PureTech logo and wave mark, and "Healthy homes start with PureTech" are trademarks and service marks of PureTech Home Services LLC. You may not use them without our prior written permission. Third-party names, marks, and certification badges appearing on the Site are the property of their respective owners and are used to identify credentials, affiliations, or products.

5.3 Copyright Complaints

If you believe content on the Site infringes your copyright, send written notice identifying the copyrighted work, the material you claim is infringing and its location on the Site, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate and that you are authorized to act, to: PureTech Home Services LLC, Attn: Copyright Agent, W10919 Helleckson Rd, Poynette, WI 53955, or support@puretechhs.com.

6. Permitted & Prohibited Uses

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  1. Use the Site in any way that violates federal, state, local, or international law or regulation.

  2. Upload or transmit any viruses, malware, or other harmful code.

  3. Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems.

  4. Use any robot, spider, scraper, or automatic device to monitor, harvest, or copy Site content, or to submit forms, without our prior written consent.

  5. Impersonate any PureTech Company, our owners, employees, technicians, or contractors, or any other person or entity.

  6. Submit false, misleading, or fraudulent information through any form, including booking or estimate requests you do not intend to honor.

  7. Use the Site or any content to develop, train, or fine-tune a machine learning or artificial intelligence model without our prior written consent.

7. Reviews, Testimonials & Submissions

If you post a review, testimonial, photograph, comment, or other material about the PureTech Companies on the Site or on a third-party platform, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, and adapt that material in our marketing, along with your first name and general locality. You represent that the material is your own honest experience and does not infringe anyone’s rights.

We never condition a discount, refund, warranty benefit, or any other consideration on the content of a review, and we do not suppress or remove honest negative reviews. Reviews displayed on the Site may be excerpted for length; the full text remains available on the originating platform.

Marketing use of project photographs taken at your property is governed by your Service Agreement, not by this Section, and you may opt out of marketing use at any time by written notice without affecting documentation, warranty, or compliance uses.

8. Online Bookings, Estimates & Purchases
8.1 Booking Requests

Submitting a scheduling request constitutes an offer to purchase the relevant Services. Acceptance occurs only when we send a written confirmation. A request submitted through the Site does not reserve a date until confirmed.

8.2 Estimates

Any price estimate provided through the Site, by telephone, or by e-mail is non-binding until confirmed in a written Quote and Service Agreement accepted by both parties. Written Quotes are valid for thirty (30) days from the date of issue, after which pricing and availability may change. Estimates assume normal, accessible conditions; concealed or pre-existing conditions discovered during work are addressed by written change order.

8.3 Payments

You agree to pay all fees and charges in accordance with the payment terms stated on your Quote and Service Agreement. Card payments are processed by a third-party payment processor; we do not store full payment card numbers. Past-due balances accrue interest as stated in your Service Agreement. Deposits are applied solely to materials and mobilization for your project and are handled in accordance with Wis. Stat. § 779.02(5).

8.4 Pricing, Availability & Content Errors

We work to keep the Site accurate, but pricing ranges, service descriptions, availability, and informational content may contain errors or become out of date. We reserve the right to correct any error and to decline or cancel any request arising from an obvious pricing or description error, and we will notify you and refund any amount already collected if we do. Service areas, service lines, and published price ranges may change without notice.

8.5 Which Agreement Governs — Order of Precedence

If there is any conflict or inconsistency among the documents below, the following order of precedence applies, from highest to lowest:

  1. Any signed written Service Agreement, Quote, or Change Order between you and the applicable PureTech Company — including the PureTech Radon Mitigation Agreement and the PureTech Electric Electrical Services Agreement — together with their exhibits and written warranties;

  2. Required statutory or regulatory consumer notices furnished with that agreement, which control over any inconsistent contract term;

  3. These Terms of Use;

  4. Any other content on the Site, including service pages, guides, blog posts, FAQs, and marketing materials.

CONTENT ON THIS SITE IS GENERAL AND INFORMATIONAL. IT DOES NOT MODIFY, EXPAND, OR LIMIT THE SCOPE, PRICING, WARRANTY, OR PERFORMANCE TERMS OF A SIGNED SERVICE AGREEMENT.

9. Cancellation, Rescheduling & Your Right to Cancel
9.1 Your Statutory Right to Cancel Comes First

IF YOUR TRANSACTION WAS SOLICITED OR AGREED TO SOMEWHERE OTHER THAN OUR REGULAR PLACE OF BUSINESS — INCLUDING AT YOUR HOME — OR OTHERWISE QUALIFIES AS A "CONSUMER APPROVAL TRANSACTION" UNDER WIS. STAT. §§ 423.201–.203 OR A COVERED SALE UNDER THE FTC COOLING-OFF RULE (16 CFR PART 429), YOU MAY CANCEL WITHOUT PENALTY OR OBLIGATION UNTIL MIDNIGHT OF THE THIRD BUSINESS DAY AFTER YOU SIGN OR RECEIVE THE REQUIRED NOTICE, WHICHEVER IS LATER.

Two copies of a Notice of Cancellation are provided with your Service Agreement. If you cancel within that period, all payments are returned within ten (10) business days. No cancellation fee, late-change fee, or deposit forfeiture described in this Section applies to a cancellation made within your statutory cancellation period, and nothing in these Terms waives or shortens that right.

Separately, nothing in these Terms waives or requires you to waive any right or defense you have under Wis. Admin. Code ch. ATCP 110 or Wis. Stat. § 100.20, and any provision that would do so is deemed deleted.

9.2 Scheduling Notice Windows

Outside any statutory cancellation right, the following courtesy windows apply to scheduled appointments:

  • Standard Services (radon measurement, filter replacement, diagnostic visits, on-site consultation): you may cancel or reschedule up to 12 hours before the scheduled arrival window at no charge.

  • Projects Requiring Special-Order Parts or Permits (mitigation installations, whole-home systems, panel and service upgrades, generator and EV-charger installations): 72 hours notice is required, because materials are ordered and permits are pulled specifically for your job.

9.3 How to Cancel or Reschedule

E-mail support@puretechhs.com and call (608) 292-4221 during business hours. Your change is effective when we confirm receipt in writing. A statutory cancellation under Section 9.1 may be made by any written notice, including e-mail, and is effective when sent.

9.4 Late-Change Fee

Subject to Section 9.1, changes made inside the applicable notice window incur a late-change fee equal to the greater of (a) $50 or (b) 15% of the quoted job price. This covers technician scheduling, reserved equipment, permit and special-order costs, and administrative time. The same fee applies if we arrive on site and cannot perform the work due to inaccessibility, missing authorizations, unsafe conditions, or no adult 18 or older present where required.

9.5 Deposits & Refunds

Any deposit you paid is fully refundable if you cancel within the applicable notice window or within any statutory cancellation period. For late cancellations, the late-change fee is deducted from the deposit and the remainder, if any, is returned within seven (7) business days. Non-returnable special-order materials already purchased for your project are additionally chargeable at documented cost, and we will provide the supporting invoices.

9.6 PureTech-Initiated Changes; Force Majeure

We may reschedule for weather, supply-chain disruption, permit or inspection delays, illness, labor shortage, or safety reasons. We will notify you as soon as practical and offer the next available date or a full deposit refund — your choice. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, and this Section does not extend to your payment obligations for work already performed.

9.7 Emergencies

We waive the late-change fee for genuine emergencies, including severe illness, death in the family, fire, or flood. We may request reasonable documentation.

10. Service-Specific Disclaimers
10.1 Radon Measurement & Mitigation

Radon levels fluctuate with weather, season, HVAC operation, occupant behavior, and building conditions outside our control. Statements on this Site about typical outcomes, expected reductions, or system performance are general and informational only and are not a guarantee of results at your property.

Any performance guarantee applicable to your project is stated in your signed Radon Mitigation Agreement and applies only on its terms. Nothing on this Site expands, limits, replaces, or disclaims that guarantee. Where your Agreement provides a performance guarantee, that guarantee governs; where it does not — including service, repair, and inspection work on systems we did not install — no performance outcome is warranted.

Radon concentrations can change after mitigation. You are responsible for retesting as described in your Agreement — generally within 7 to 30 days after installation or repair, then at least every two (2) years and after significant building or HVAC changes — and for maintaining power to the system and monitoring the system indicator.

10.2 Electrical Services

Electrical work is contracted for and performed by PureTech Electric LLC, Wisconsin Electrical Contractor Registration No. 1701-EC. Descriptions of electrical services on this Site are informational and do not constitute a bid, an offer, or a representation that any particular scope is appropriate for your property.

Properties may contain latent or pre-existing conditions — including aluminum branch wiring, knob-and-tube wiring, ungrounded or undersized circuits, overfused or obsolete panels, deteriorated insulation, prior unpermitted work, and conditions concealed behind finishes — that are not reasonably discoverable before work begins and are not included in any published price. Where an inspector requires corrections to pre-existing wiring or equipment not installed by us, those corrections are addressed by written change order. Permits, inspections, and code compliance are handled as described in your Electrical Services Agreement.

10.4 General Information Only

Guides, blog posts, FAQs, calculators, radon maps, zip-code lookups, and similar content on the Site are for general informational purposes and should not be relied upon as professional, engineering, medical, legal, or real estate advice, or as a substitute for a professional measurement or on-site evaluation of your specific property. Radon risk maps and regional data describe general geographic tendencies and do not predict the radon level in any individual building.

11. Service Warranties & Construction Defect Notice

Warranties on work we perform are set out in your written Service Agreement, not on this Site. Each PureTech Company provides its own written limited workmanship warranty covering its own scope, and passes through applicable manufacturer warranties on equipment and materials. Warranty terms, exclusions, transferability, and claim procedures are stated in that written warranty and control over any summary, chart, or description appearing on the Site.

NOTICE CONCERNING CONSTRUCTION DEFECTS. WISCONSIN LAW CONTAINS IMPORTANT REQUIREMENTS YOU MUST FOLLOW BEFORE YOU MAY FILE A LAWSUIT FOR DEFECTIVE CONSTRUCTION AGAINST THE CONTRACTOR WHO CONSTRUCTED YOUR DWELLING OR COMPLETED YOUR REMODELING PROJECT OR AGAINST A WINDOW OR DOOR SUPPLIER OR MANUFACTURER. SECTION 895.07(2) AND (3) OF THE WISCONSIN STATUTES REQUIRES YOU TO DELIVER TO THE CONTRACTOR A WRITTEN NOTICE OF ANY CONSTRUCTION CONDITIONS YOU ALLEGE ARE DEFECTIVE BEFORE YOU FILE YOUR LAWSUIT, AND YOU MUST PROVIDE YOUR CONTRACTOR OR WINDOW OR DOOR SUPPLIER THE OPPORTUNITY TO MAKE AN OFFER TO REPAIR OR REMEDY THE ALLEGED CONSTRUCTION DEFECTS. YOU ARE NOT OBLIGATED TO ACCEPT ANY OFFER MADE BY THE CONTRACTOR OR WINDOW OR DOOR SUPPLIER. ALL PARTIES ARE BOUND BY APPLICABLE WARRANTY PROVISIONS.

The Wisconsin Department of Safety and Professional Services brochure describing the right-to-cure process under Wis. Stat. § 895.07 is furnished with each Service Agreement and is available at dsps.wi.gov.

12. Disclaimer of Warranties (Site)

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PURETECH COMPANIES DISCLAIM ALL WARRANTIES REGARDING THE SITE — EXPRESS OR IMPLIED — INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

This Section applies to the Site only. It does not disclaim, and has no effect on, the written warranties provided with services we perform under a Service Agreement, or any warranty that cannot be disclaimed under Wisconsin law.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE PURETECH COMPANIES, THEIR OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) US$5,000 OR (B) THE TOTAL AMOUNT YOU PAID THE APPLICABLE PURETECH COMPANY FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.

NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR FOR ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. NOTHING IN THESE TERMS LIMITS ANY RIGHT OR REMEDY YOU HAVE UNDER WISCONSIN CONSUMER PROTECTION LAW.

Liability arising from services we perform is governed by the limitation of liability provision in your Service Agreement, which controls over this Section as to those services. Some jurisdictions do not allow certain limitations, and those limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless the PureTech Companies and their owners, officers, members, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your misuse of the Site. This Section does not apply to claims arising from our own negligence or misconduct, and does not apply to the performance of services, which is governed by the indemnity provisions of your Service Agreement.

15. Third-Party Links & Resources

The Site may contain links to third-party websites, tools, or resources, including scheduling platforms, payment processors, mapping services, review platforms, and government or industry references such as the EPA, AARST, NRPP, and Wisconsin DSPS. These links are provided for convenience only. We do not endorse and are not responsible for the content, products, services, or privacy practices of those websites.

16. Modification of Terms & Site

We reserve the right to modify these Terms or any portion of the Site at any time in our sole discretion, including to add or remove a PureTech Company from Section 2. Changes are effective when posted, and we will update the Last Updated date. Changes are not retroactive and do not alter any Service Agreement already signed. Your continued use of the Site after changes are posted constitutes acceptance of those changes.

17. Governing Law & Dispute Resolution
17.1 Governing Law

These Terms and any dispute arising under them are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws provisions.

17.2 Informal Resolution First

Most concerns are resolved quickly by talking with us. Before commencing any formal proceeding, you agree to contact us at support@puretechhs.com or (608) 292-4221 and give us thirty (30) days to work the matter out in good faith. We commit to the same.

17.3 Disputes About Services

Any dispute concerning services we performed or agreed to perform is governed by the dispute resolution provision of your Service Agreement, which requires, as applicable: the Wisconsin right-to-cure process under Wis. Stat. §§ 101.148 and 895.07 for construction-defect claims; good-faith conferral; and one session of non-binding mediation with a mutually agreed mediator, with mediator fees split equally. If the dispute is not resolved, venue lies in the Circuit Court for the Wisconsin county in which the property is located. This process does not apply to small claims actions or to collection actions for amounts due.

17.4 Disputes About the Site

Any dispute concerning your use of the Site that is not governed by a Service Agreement will be brought exclusively in the state or federal courts located in Columbia County, Wisconsin, and you and we consent to the personal jurisdiction of those courts. This does not prevent either party from bringing an action in small claims court.

17.5 No Waiver of Consumer Rights

Nothing in this Section waives, limits, or requires you to waive any right, defense, or remedy available to you under Wis. Admin. Code ch. ATCP 110, Wis. Stat. § 100.20, Wis. Stat. § 895.447, or any other Wisconsin consumer protection law. Any provision of these Terms that would do so is deemed deleted.

18. General Provisions

Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate, to a successor PureTech Company, or in connection with a merger, reorganization, or sale of assets, on notice to you.

Notices. Notices to you may be given by e-mail to the address you provided, by text message, or by posting on the Site. Notices to us must be sent to support@puretechhs.com or to the mailing address in Section 3.

Severability. If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.

Survival. Sections 2.6, 5, 7, 8.5, 10, 11, 12, 13, 14, 17, and 18 survive termination of your use of the Site.

No third-party beneficiaries. These Terms create no rights in any person who is not a party to them, except that each PureTech Company and its owners, members, employees, and contractors may enforce the disclaimers, limitations, and indemnities stated in their favor.

Headings. Headings are for convenience only and do not affect interpretation.

19. Entire Agreement

These Terms, together with our Privacy Policy, our Accessibility Statement, and any separate Service Agreement, Quote, Change Order, or written warranty expressly incorporated herein, constitute the entire agreement between you and the PureTech Companies regarding the Site and Services, and supersede all prior website terms. In case of conflict, the order of precedence in Section 8.5 applies.
